SALES CONTRACT

          This is my standard sales contract and health guarantee for Beagles I occasionally sell. Every Beagle I sell is out of registered parents and eligible for both competitions and breeding, unless otherwise noted and agreed to between the buyer and the seller at the time of sale in paragraph 6 of this contract. All of my Beagles are of the absolute best quality and are bred specifically to be used for family-pets, hunting, and/or breeding.

All Beagles are sold with the following conditions:

1.  Seller certifies said dog/bitch to be in good health on the date of sale unless noted on this sales contract and agreed to between seller and buyer in paragraph 6 below.

2.  For this sales agreement/health guarantee to stay in effect, the dog/bitch must be taken to a veterinarian of the buyer's choice and at the buyer's expense within 48 hours of the time of sale for a health check. A signed statement from the veterinarian concerning the Beagle's condition must reach the seller within 72 hours (end of 3rd day) of the time of the examination completion and must be sent in a method that requires a signature when delivered as proof of date and time of delivery and proof of person receiving the letter containing the document. Failure to do so will cancel this entire contract and relieve the seller of all liability.

[Inserted Note Concerning Puppies Shipped By Airfreight] For all buyers that are having their puppy shipped by airfreight, whether you live in-state, out-of-state or out-of-country, we take your puppy to a licensed Vet (at the seller's expense) and send the puppy with an official Health Certificate. We do this for three reasons: (1) It is a requirement of all airlines to ship live-animals out of state or out of country; (2) we feel this is the least we can do since you decided to make a long distance purchase from our kennel; and (3) this prevents all allegations that a dog or puppy was sick when it left our kennels and thus the health certificate is the health guarantee for your puppy if shipped by airfreight.

3.  If the dog/bitch is found to be ill on its first Vet examination must be within 48 hours of the time of sale (end of 2nd day). The dog/bitch can then be returned to the seller at the buyer's expense within 72 hours of the time of sale (end of 3rd day); or the buyer can keep the puppy, have the buyer's Vet treat the illness, send an itemized copy of the Vet bill (showing illness diagnosis, medicines given - prescription & over-the-counter, and medicine costs broken down by prescription only and over-the-counter) to the seller, and the seller will pay the "prescription only medication costs" up to a maximum of $25. Either of these two options can be exercised by the buyer if a puppy is found to be sick by a licensed Vet during the first 48 hours of ownership and the buyer makes proper notifications to the seller within these above listed time frames; no exceptions.

4.  I normally remove both the front and rear dew claws, but do not guarantee that dew claws will always be removed. I remove the dew claws on a large percentage of my Beagles mainly for cosmetic reasons only. A small percentage of the pups that have their front dew claws removed, may even grow the front dew claws back after they are removed. The reason they sometimes grow back is because they have a bone inside of them, and because they are removed from the puppy at the tender age of three days. Should you buy a pup from us that has dew claws, you can cut the dew claw nails just like the rest of your dog's nails, or you can have the dew claws surgically removed by a Vet at your own expense.

5.  I can not guarantee the height a Beagle will reach at maturity if the Beagle is purchased from me and it is less than one year of age. Beagles typically vary in size from 10-16 inches in height as measured across the top of the back just behind the shoulder blades. Beagles may compete in two classes for competitions (13" and under and over 13 inch up to 15") but their is no such thing as a 13" and 15" type of Beagle. All of our breeding stock varies in size from approximately 12-14 inches.

Provided the Beagle is returned to the breeder/seller with a signed statement from a licensed veterinarian that the puppy was examined by this Vet within 2 days (48 hours of time of purchase) and that the pup has a serious genetic or health problem, along with all health records and the original sales receipt, the seller agrees to a cash refund under the following conditions:***

        1. )  Within 72 hours (end of 3rd day) of the time of purchase: Refund: 100% of purchase price of puppy, not including fees paid for extra services such as micro-chipping, crate, pedigree, etc.

        2. )  The buyer agrees to provide an acceptable standard of health care for this dog/bitch for the entire time of ownership, including regular, annual veterinary examinations, vaccinations, proper nutrition and housing.

        3. )  After the 3rd day from the date of purchase, if for any sound reason the buyer is unable to keep or maintain this dog/bitch, the seller agrees in advance to secure this Beagle back into the seller's ownership, accompanied by the dog's/bitch's appropriate registration papers (if sold as registered) and complete health records, for the price of $1.00 (one dollar). This guarantee alleviates the possibility of any of my Beagles ever ending up unwanted and homeless on the street, and prevents the buyer from searching for a reliable Beagle rescue service to take your Beagle.  In other words, "IF YOU BUY A BEAGLE FROM ME, I GUARANTEE TO ALWAYS TAKE IT BACK FOR ANY REASON AND SEE THAT IT HAS A GOOD HOME."

6.  Additional Sales Information For This Particular Sale Only.

          ***I cannot guarantee that male puppies will drop two normal testicles by eight weeks of age. Any male with an undescended testicle is considered undesirable for stud purposes. Neutering is strongly recommended.

7.  The buyer understands and agrees that, while I do my best to insure that my animals are genetically sound, I cannot guarantee the lifetime health of any Beagle beyond its condition at the time of sale. No other warrantees or guarantees of any kind, expressed or implied are made under this contract except as stated herein.
